Terms and Conditions of Sale and Event Registration Terms

1. Parties, scope and contract documents

These terms (the "Terms") govern tickets and registrations sold by Tucana Global, S.L.U., CIF/NIF B66329566, for a PAWorld, PAWorld365 or People Analytics World conference, meeting, webinar, digital programme or related event (the "Event").

The person or organisation placing the order is the "Customer". A person registered to attend is an "Attendee". A Customer acting for purposes wholly or mainly outside a trade, business, craft or profession is a "Consumer". Any other Customer is a "Business Customer".

The contract comprises:

  1. the Event page and final checkout summary for the ticket purchased;
  2. these Terms, including their participation and conduct provisions;
  3. the Refund, Cancellation, Substitution and Event Changes Policy (the "Refund Policy");
  4. any venue, platform or event-specific rules clearly made available before purchase; and
  5. the order confirmation.

Event-specific information in the final checkout summary prevails for the Event, ticket, price and inclusions purchased. The Refund Policy prevails for cancellations, refunds, substitutions, postponements and material Event changes. Mandatory law prevails over all contract terms.

2. Event information and ticket inclusions

Before the Customer places an order, the Event page and checkout identify the Event name, date, start time and time zone, venue or online platform, delivery format, ticket type, principal characteristics, key inclusions, currency, tax, mandatory charges and total price. Those details form part of the contract and are repeated or linked in the order confirmation.

A ticket includes only the admission, sessions, materials, catering, networking functions, event-app access or digital content expressly described for that ticket type. Unless expressly included, a ticket does not cover travel, accommodation, visas, insurance, devices, internet access, optional social activities, training accreditation, continuing professional education credits, or goods and services supplied by exhibitors, sponsors, venues or other third parties.

Events are primarily designed for professional participants aged 18 or over. A person under 18 may attend only with Tucana's prior written approval and subject to any supervision, consent or safeguarding measures Tucana reasonably requires.

For an online or hybrid Event, the Attendee is responsible for a compatible device, supported browser, reliable internet connection and any technical requirements stated on the Event page.

3. Accessibility, dietary needs and reasonable adjustments

Tucana aims to make Events accessible and inclusive. An Attendee who needs a reasonable adjustment, communication support, mobility assistance or accommodation for an allergy or dietary requirement should contact support@peopleanalyticsworld.com as early as possible. We will consider requests reasonably and in accordance with applicable law, but cannot guarantee that every request can be fulfilled, particularly where information is supplied late or the venue or a third party controls the relevant service.

Information about health, disability, allergy or dietary requirements will be handled in accordance with the Privacy Notice. Attendees remain responsible for making any personal medical arrangements and for asking venue or catering staff about ingredients where needed.

4. Price, taxes, payment and invoices

The total amount payable, currency, applicable tax and any mandatory charge are shown clearly before the Customer submits the order. Optional extras are not added unless selected by the Customer.

Prices may change before purchase by Event, ticket type, sales phase, month, availability, quantity or promotional code. The price shown in the final order summary and accepted at checkout governs the order. A Customer is not entitled to a retrospective price match after completing a purchase.

Tucana is the seller and merchant for the ticket. Stripe processes card and other electronic payments on Tucana's behalf. The Customer authorises Tucana and Stripe to charge the selected payment method for the total displayed at checkout. Tucana does not normally receive the full card number. A bank or card issuer may apply currency-conversion or international-transaction charges outside Tucana's control.

A Business Customer must provide its correct legal name, billing address, tax number and any valid exemption, resale or reverse-charge information before invoicing. Tucana may issue a corrected or additional invoice where tax should have been charged but was not, or where information supplied by the Customer was inaccurate or incomplete. The Business Customer must pay any additional tax properly due. The Business Customer is responsible for interest, penalties or surcharges to the extent caused by its inaccurate, incomplete, late or misleading information.

If a price, availability or configuration error is obvious and could reasonably have been recognised as an error, Tucana may promptly offer the Customer the correct terms or cancel the affected order and refund the amount paid for it.

5. Online ordering, correction and contract formation

The online purchasing process is:

  1. select an Event and ticket;
  2. enter Customer, Attendee and billing information;
  3. review the order summary and correct any input errors;
  4. accept these Terms and the Refund Policy;
  5. review the Privacy Notice; and
  6. activate the payment button labelled "Pay now - order with obligation to pay" or an equally clear formulation.

Before payment, the Customer can use the edit, basket and back controls to identify and correct errors. After purchase, a correction request should be sent promptly to support@peopleanalyticsworld.com. Correcting a spelling, contact or billing error does not entitle the Customer to change the ticket type or price unless Tucana agrees or mandatory law requires it.

An order is an offer to buy. The contract is formed when Tucana sends the order confirmation to the email address supplied. A payment authorisation or temporary card hold without an order confirmation does not, by itself, confirm admission. If the Customer has not received confirmation within 24 hours, the Customer should check spam folders and contact support before placing a duplicate order.

Before purchase, these Terms and the other contract documents are available in a form that can be downloaded, printed, stored and reproduced. Tucana records the order, the final commercial summary, the selected contract language and the versions of the legal documents accepted. The confirmation email supplies or links to that information on a durable medium. A copy may also be requested from support.

The contract may be concluded in English or Spanish. The language selected in the checkout is the contract language. Where the two published language versions differ, the version selected and supplied with the order governs, subject to mandatory law.

A person ordering for a company or another individual confirms that they have authority to place the order and provide the relevant registration details.

6. Tickets, named Attendees and delivery

Tickets are delivered electronically to the email address supplied, or made available in the Customer's or Attendee's PAWorld365 account. The Customer must check the confirmation and notify Tucana promptly of an error.

A ticket is a limited, conditional right of admission to the specified Event. It is not a transferable financial asset and does not confer ownership of Event content, recordings, attendee data or other intellectual property.

Tickets are normally allocated to named Attendees. Where the Customer registers another person, the Customer confirms that it is authorised to provide that person's details and will ensure that the Attendee receives the Privacy Notice and these Terms, including their participation and conduct provisions. Tucana may contact the Attendee directly for Event administration, access, safety and service communications.

The Customer and Attendee must protect ticket codes, links and account credentials. Tucana may cancel or replace a duplicated, copied, fraudulently obtained or compromised ticket after reasonable checks.

7. Substitutions, transfers and resale

Attendee substitutions and any permitted transfer are governed by the Refund Policy. A valid substitution changes the Attendee but not the Customer responsible for payment and compliance with the contract.

A ticket must not be copied, auctioned, resold above the price paid, bundled into an unauthorised promotion, or transferred through an unofficial marketplace, except to the extent mandatory law expressly permits. Tucana may refuse or cancel an unauthorised or fraudulent ticket after reasonable investigation. Any mandatory consumer or ticket-resale rights remain unaffected.

8. Customer cancellation and no-show

The Customer's voluntary cancellation, refund and no-show rights are set out in the Refund Policy. The default cancellation scale is:

  • more than 60 calendar days before the Event starts: 80% refund;
  • 31 to 60 calendar days before the Event starts: 50% refund; and
  • 30 calendar days or fewer before the Event starts: no refund.

A different flexible-ticket or cancellation rule applies only where it was clearly stated on the Event page and at checkout before purchase. Mandatory rights remain unaffected.

9. Programme and operational changes

Event programmes are planned in good faith. Speakers, moderators, sessions, running order, rooms, catering, exhibitors, networking formats and supporting technology may change. Tucana does not guarantee the attendance of a named speaker, sponsor or participant, any minimum number of meetings or leads, or any particular professional or commercial result.

A reasonable change that does not alter the Event's essential nature is not a cancellation and does not by itself create a refund right. Examples include a speaker substitution, room change, reasonable timetable adjustment, catering variation, or a venue change within the same city or metropolitan area.

Where Tucana makes a material change, the remedies in the Refund Policy apply. A material change normally includes changing the Event date, moving it to a different city, changing an in-person Event to online-only, or substantially reducing its advertised duration.

10. Postponement, relocation, cancellation and force majeure

Tucana may postpone, relocate, change the format of, curtail or cancel an Event where reasonably necessary for safety, venue availability, law, public health, transport disruption, industrial action, severe weather, security, civil emergency, governmental restriction, sanctions, utility or communications failure, major technology failure, or another circumstance beyond Tucana's reasonable control.

Tucana will notify Customers using the contact details supplied and apply the Refund Policy. If Tucana cancels the entire Event and does not provide an agreed replacement, the Customer is entitled to a refund of the ticket price, applicable tax and mandatory booking charges paid to Tucana for that Event.

Travel, accommodation, visas, insurance, time away from work and other third-party costs are not included in a ticket refund, except where mandatory law requires otherwise.

11. Consumer withdrawal rights

Tickets are for Event services provided on a specified date or during a specified period. Where applicable law treats the Event as a dated service within an exception for leisure-related activities, the usual 14-day distance-contract withdrawal right does not apply.

If that exception does not apply to a particular Consumer or Event, the Consumer retains any mandatory withdrawal right and may exercise it by sending a clear statement to support@peopleanalyticsworld.com. Where the Consumer expressly requests a service to begin during a withdrawal period, the Consumer may be required to pay a proportionate amount for service already supplied. Where the service has been fully performed following the Consumer's express request and acknowledgement, the withdrawal right may end in accordance with applicable law.

These statutory rights are separate from, and may be more favourable than, the contractual cancellation rights in the Refund Policy. A Business Customer has no consumer cooling-off right.

12. Admission, identity and conduct

Attendees must comply with the participation and conduct provisions in these Terms, reasonable instructions from Tucana and venue or platform personnel, security and access procedures, and applicable law. This includes treating others professionally, respecting privacy and intellectual property, and not engaging in harassment, discrimination, threats, unsafe activity, unauthorised selling, covert data collection or unauthorised recording.

Tucana may request reasonable proof of identity or eligibility for a restricted ticket category. Tucana may refuse admission, remove or suspend an Attendee, or restrict access where reasonably necessary for safety, security, law, fraud, serious misconduct or a material breach. Before taking action, Tucana will consider the circumstances and any proportionate alternative where reasonably practicable. An Attendee removed for their own serious breach is not entitled to a refund except where mandatory law requires otherwise.

13. Photography, filming and recording

Events may be photographed, filmed, livestreamed or recorded. General crowd, atmosphere and session images may include Attendees incidentally and may be used to document, report on and promote Tucana's events and content. Tucana will provide appropriate notices and, where reasonably available, a process for an Attendee to raise a concern or request a no-photo indicator. Separate permission will normally be requested for a staged interview, testimonial or prominent individual promotional feature.

Attendees must not record, livestream, reproduce or commercially distribute sessions, speakers or other Attendees without permission. Personal photographs are permitted only where the Event and the people concerned allow them and they are taken respectfully.

14. Online Events, Event app and networking features

Access credentials and links for an online Event or Event app are personal to the authorised Attendee. The Attendee must not share them or permit unauthorised access.

Interactive functions may allow an Attendee to create a profile, post content, message participants, join meetings, submit questions or appear in a recording. The Attendee is responsible for content they choose to submit and must not upload unlawful, confidential, infringing, discriminatory, malicious or misleading material.

Tucana may moderate, remove or restrict content or access where reasonably necessary to operate the service, protect participants or comply with law. Tucana does not guarantee uninterrupted access where disruption results from the Attendee's device, connection or third-party network, but will use reasonable care in operating systems under its control.

15. Intellectual property and permitted use

Event programmes, presentations, recordings, websites, apps, branding and materials are protected by intellectual property rights belonging to Tucana, speakers, sponsors or other licensors.

An Attendee may use supplied materials for personal learning and internal business reference. Unless the relevant owner has given permission, an Attendee must not:

  • reproduce or distribute a substantial part of a session, recording or material;
  • remove rights notices or misrepresent authorship;
  • sell, sublicense or make content publicly available;
  • scrape attendee, speaker, sponsor or programme data;
  • use content or data to build a competing event, directory or commercial database; or
  • use recordings, transcripts, images or materials to train or evaluate an artificial-intelligence model.

Nothing in the contract transfers ownership of intellectual property to the Customer or Attendee.

16. Privacy and communications

Tucana processes Customer and Attendee personal data as described in the Privacy Notice. Service communications needed to process payment, issue tickets, operate the Event, communicate safety or programme information, or respond to a request are not marketing.

Marketing choices are separate from acceptance of these Terms. Consent may be withdrawn and direct marketing may be objected to at any time. Attendee information is disclosed to a sponsor for marketing only where the Attendee has made a valid choice or provided a valid sponsor-specific lead-capture consent, as described in the Privacy Notice.

17. Travel, visas and third-party services

The Customer and Attendee are responsible for travel, accommodation, passports, visas, immigration requirements, insurance and personal arrangements. Tucana may provide an attendance confirmation or factual visa-support letter after payment, but does not guarantee that a visa or entry permission will be granted.

A venue, hotel, airline, exhibitor, sponsor or other third party supplies its own goods or services under its own terms. Tucana is not responsible for that third party's independent acts or omissions, except where Tucana is legally responsible for selecting or directing the supplier or where liability cannot lawfully be excluded.

Attendees are responsible for their possessions. Lost-property enquiries will be handled reasonably, but Tucana does not accept custody of personal items unless it expressly does so.

18. Liability

Nothing in the contract excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, deliberate misconduct, or a Consumer's mandatory statutory rights.

For a Consumer, Tucana is responsible for foreseeable loss or damage caused by Tucana's failure to use reasonable care or comply with the contract. Tucana is not responsible for loss that was not foreseeable when the contract was formed, for business loss suffered by a Consumer, or for loss caused by the Consumer's own breach or by matters outside Tucana's reasonable control, subject always to mandatory law.

For a Business Customer, to the fullest extent permitted by law:

  • Tucana is not liable for indirect or consequential loss, or for loss of profit, revenue, anticipated savings, opportunity, goodwill or business interruption;
  • Tucana's aggregate liability arising from a ticket order is limited to the amount paid to Tucana for the affected ticket or tickets; and
  • the limitations do not apply to payment obligations, fraud, wilful misconduct, death or personal injury caused by negligence, infringement or misuse of intellectual property, breach of confidentiality, unlawful processing of personal data, or liability that cannot lawfully be limited.

Event content is provided for professional information and discussion. It is not legal, financial, medical, employment or other regulated professional advice, and neither Tucana nor a speaker guarantees that it is complete, current or suitable for a particular decision.

19. Complaints, support and chargebacks

Ticket, refund or service concerns should be sent to support@peopleanalyticsworld.com with the order number, Event name and a concise explanation. Tucana will respond as soon as reasonably possible and, for consumer complaints, no later than 15 days after receipt.

Where possible, the Customer should contact Tucana before starting a chargeback so Tucana can investigate and avoid duplicate refunds. This request does not restrict a valid statutory or card-scheme right. Tucana may contest an inaccurate, duplicate or abusive chargeback and recover any duplicate payment or refund.

If a consumer complaint remains unresolved, Tucana will provide on a durable medium the information required by applicable alternative dispute resolution law, including any competent accredited entity and whether Tucana will participate. This does not prevent either party from using the courts where entitled.

20. Governing law and jurisdiction

The contract is governed by Spanish law.

A Consumer retains the protection of mandatory law applicable in the country of habitual residence and may bring proceedings in any court entitled to hear the claim under mandatory consumer-jurisdiction rules.

For a Business Customer, the courts of Barcelona, Spain have exclusive jurisdiction. This does not prevent either party from seeking urgent interim or protective relief in any competent court.

21. General terms

If a provision is invalid or unenforceable, it will be treated as modified to the minimum extent needed, or removed if modification is not possible, without affecting the remaining provisions.

A failure or delay in enforcing a right is not a waiver. Rights and remedies are cumulative where law permits.

The Customer may not assign a Business Customer contract without Tucana's written consent, except as part of a genuine transfer of substantially all of the relevant business. Tucana may transfer the contract as part of a reorganisation or transfer of its Event business, provided this does not reduce a Consumer's rights.

No person other than Tucana, the Customer and, where relevant, the Attendee has a right to enforce the contract, except that intellectual property owners, venues and service providers may enforce provisions expressly intended to protect them where applicable law permits.

The version accepted at checkout governs the order. Tucana may update these Terms for future purchases. Operational rules may be updated where reasonably necessary for law, safety, security, accessibility or venue operations, but an update will not remove a Customer's core paid entitlement or mandatory rights.
